Network's Charter

The professional network of the students and graduates of KEDGE BUSINESS SCHOOL (hereinafter the “Network”) is managed by the ASSOCIATION Groupe KEDGE BUSINESS SCHOOL. Its purpose is to facilitate the integration and professional mobility of graduates, put them in contact with partner companies, and allow them to remain connected with their school.

 

1. Objective

This purpose of this Charter is to set forth the general conditions for using services offered on the Network’s Website
www.kedgebs-alumni.com(hereinafter “Website”) by its Members.

The Website offers its Members:

  • an electronic mail service (an email address that allows for the forwarding of electronic mail to a personal email address, without allocations as to storage space) reserved to graduates and students;
  • a graduate and student directory;
  • a job placement service;
  • information and news services (newsletters, events, schedule, etc...);
  • services related to the professional careers of graduates; and
  • the ability to organise in groups and conduct surveys in accordance with the specific supplementary conditions detailed below.


The Association Groupe KEDGE BUSINESS SCHOOL (hereinafter “KEDGE BUSINESS SCHOOL”) furnishes its services and tools under the conditions of use described below.

Where certain services are subject to specific conditions of use, notices appear on the home pages of the service(s) concerned that members are requested to accept.

KEDGE BUSINESS SCHOOL is technically responsible, whether directly or indirectly, for hosting the services and making the tools offered on the Website available. Each Member of the Network is responsible for the use he or she makes of the Website, and the information or messages he or she disseminates therein.

Members are solely and entirely responsible for their utilisation of the Website www.kedgebs-alumni.com. KEDGE BUSINESS SCHOOL shall not be held responsible for any damages, whether direct or indirect, in including but not limited to: material damages, loss of data or programs, or financial damages that may result from the use of the Website or websites linked to it.

 

2. Conditions of Subscription and Access to the Network and the Website

The Network and the Website are not open access. Access is reserved to Members of the Network, having accepted the present Charter, and assigned a username and password.

The persons entitled to be Members of the Network and to have access to the Website are, firstly, students and graduates of KEDGE BUSINESS SCHOOL programmes and, secondly, authorised representatives of partner companies for publishing job offers.

The Members of the Network agree to provide truthful information at the time of their registration and to update it in the event of any changes. For this purpose, they will be regularly requested to do so by KEDGE BUSINESS SCHOOL.

Members of the Network have a username and password at their disposal. Their password is personal and confidential. Each Member of the Network is responsible for the utilisation of their password and agrees to not disclose it in any manner.

Mere access to the Website, as well as its utilisation, implies full and complete acceptance of this Charter.

 

3. Personal Data Concerning Network Members

4. Transmission of Messages within the Network

Members of the Network agree that the content of their messages will not violate in any fashion the following:

  • the rights of persons and goods;
  • the laws and regulations in force in France, in their country of residence, or in the country to which his or her data may be sent; or
  • not contain any virus or programs susceptible to causing damage.

Members agree to not transmit any unlawful, defamatory, threatening, or immoral messages or data. The transmission of any unsolicited messages of an advertising or commercial nature, or issued for political, trade union, or religious purposes, is prohibited.

Members of the Network shall refrain from sending mass e-mails to other Members of the Network. They agree to respect the image and reputation of KEDGE BUSINESS SCHOOL, and agree to not make any statements or take any actions that may cause harm to it.

Failure to comply with these rules will result in removal of the Member who sent the disputed message(s) from the Network and may further result in legal action taken by KEDGE BUSINESS SCHOOL.

 

5. Offers of Employment

Any Member of the Network who has the ability of posting or transmitting a job offer agrees to not use prohibited or discriminatory criteria. In particular, offers whose access is subject to the following criteria are prohibited: 

  • origin;
  • gender;
  • lifestyle;
  • pregnancy;
  • family situation;
  • race, ethnicity, or nationality;
  • political opinions;
  • union or membership activities;
  • religious beliefs;
  • health condition;
  • handicap;
  • sexual orientation;
  • age;
  • physical appearance;
  • surname;
  • genetic characteristics; or

6. Non-Compliance with this Charter 

KEDGE BUSINESS SCHOOL reserves the right to remove any Member from the Network who has not respected any of the clauses of this Charter. In such case, said Member's access to the Website will be automatically and immediately terminated after KEDGE BUSINESS SCHOOL has sent message to the Member advising as to the reasons for said removal.

 

7. Amendment of this Charter

This Charter may be unilaterally amended by KEDGE BUSINESS SCHOOL, in particular in order to comply with new legal or regulatory provisions. It shall inform Members of the Network by publication on the Website or by sending a message to Members by means of a mailing list.

Any access to the Network by a Member subsequent to the dissemination of the Amended Charter implies acceptance by said Member.

 

8. Intellectual Property

The Website and each of its components (such as trademarks, logos, databases, images, texts, photographs, etc.), including the software elements necessary for the operation of the Website and its databases, are the exclusive property of KEDGE BUSINESS SCHOOL. 

Any reproduction, representation, adaptation (in particular translation) or any use of the Website and its content (in general), whether in total or in part, is strictly prohibited, except when the prior written consent of KEDGE BUSINESS SCHOOL has been obtained. Any violation will constitute an act of counterfeiting and/or unfair competition, and exposes the perpetrator to civil and/or criminal penalties. 

In particular, databases set up within the framework of the Network are entitled to protection under Books I and III of the Intellectual Property Code. Any person who creates a file or database from all or part of the Network's data that is accessible on the Website, and makes it available to any third-party, whether for a fee or free of charge, without the agreement of KEDGE BUSINESS SCHOOL, and in violation of this Charter, would be liable to civil and/or criminal penalties under the Intellectual Property Code.

 

9. Litigation

This Charter is governed by French law. Any dispute relating to the validity, interpretation, or execution of this Charter and after failure of any mediation, will be submitted to the relevant courts. 

Any dispute arising within the framework of this Charter may be submitted to consumer mediation, at the request of any individual Member of the Network. However, remains free to agree to or refuse the use of consumer mediation. 

In the event that the individual Member of the Network wishes to resort to consumer mediation, he or she must send his or her complaint to KEDGE BUSINESS SCHOOL in writing to the following address (KEDGE BS, 680, cours de la Libération, 33405 Talence cedex - France) or by email to the following address (dpo@kedgebs.com). KEDGE BUSINESS SCHOOL will endeavour to respond as soon as possible. 

If the dispute is not resolved, the individual Member of the Network may, within one year of making such a complaint to KEDGE BUSINESS SCHOOL, and free of charge, have recourse to the mediation of the MEDIATION-NET Association (mediator for private educational institutions) (Address: MEDIATION-NET Consommation, 3 rue des Morillons, 75015 Paris 2; email: mediation.conso@mediation-net.com; online referral form: http://www.mediation-net-consommation.com/saisir-le-mediateur-en-ligne). The MEDIATION-NET Association is a neutral, impartial, and independent third-party from KEDGE BUSINESS SCHOOL. 

The decision rendered by the mediator shall not be binding upon the Parties, who shall remain free to submit their dispute to the competent courts.
